Motion filed to dismiss capital murder charge against Bevily

A motion has been filed to dismiss the capital murder charge against Morris Bevily in the death of his 14-month old daughter.

Assistant District Attorney Patrick E. Beasley filed the motion on Friday, just a couple of weeks after Bevily’s wife, T’Kia, was found not guilty in a retrial.

Beasley stated the State had insufficient evidence at this time to pursue charges.

The motion to dismiss the case will be brought in front of a judge for a decision.
